OFFICIAL RULES
HOW TO ENTER: No purchase necessary to enter or win. You must be 18 or older to enter. Complete and submit the registration at wafb.com from January 14, 2010 through February 6, 2010. Limit: one (1) Sweepstakes entry per person and, per email address, during Sweepstakes. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant will be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder of the registered email address. You can also enter by hand printing your name, address, and daytime phone number on a 3” x 5” card or piece of paper and mailing it to WAFB 9 Big Return Sweepstakes,31 S. Rangeline Rd., Carmel, IN 46032. Mailed entries must be postmarked and received at the above address by February 1, 2010. Emailed entries must be received by WAFB TV by February 6, 2010. No photocopies, facsimiles or mechanically reproduced entries will be accepted. No more than one entry may be submitted per stamped outer envelope. Maximum one (1) entry per person and ten (10) unique entries per household. WAFB TV will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries, including due to transmission, technical, and/or network failures of any kind, including, without limitation, malfunctioning of any hardware or software (whether originating with sender or sponsors), telephonic failures, human error, or any other error or malfunction. Any questions regarding the number of entries submitted shall be determined by WAFB TV in its sole discretion, and WAFB TV reserves the right to disqualify any entries by persons that WAFB TV determines have tampered with or abused any aspect of the Sweepstakes. All entries become the property of Sponsor(s), and Sponsor(s) reserve(s) the right to use any information submitted by entrants.
HOW TO PLAY: Simply enter at our sweepstakes web site linked to wafb.com, or send your entry in the mail, by the applicable deadline listed above. There will be a random drawing held on February 8, 2010 following the professional football championship game (i.e., Superbowl) on February 7, 2010 televised on WAFB TV for each qualified Big Return play listed below. The random prize drawing(s) will be from all the entries received before the deadlines (February 1st by mail and February 6th by email). The name drawn will win the prize associated with the first Big Return Sweepstakes Prize-Play that occurred (if any) during the Superbowl game played on February 7, 2010. If the game that WAFB TV broadcasts produces any of the following Big Returns the corresponding prize listed will be awarded. Plays nullified by a penalty are not considered eligible plays. If none of the Big Return Sweepstakes prize plays occur during the game, then there will be no winner(s). Contest is subject to the Superbowl game taking place on scheduled date of February 7, 2010.
To count as one of the above qualifying plays, the play must be recorded as an official NFL statistic.
A blocked punt returned for a touchdown is not considered as one of the above qualifying plays.
The Sponsor(s) reserve the right to substitute a prize of equal or greater value.PRIZES AWARDED: Identification of official Big Return Sweepstakes prize plays will be determined by WAFB TV and Yancey Marketing Corporation, whose judgment is final. The winners of a prize will be contacted by letter or phone from an authorized representative of WAFB TV. No other notification will be given. If WAFB TV is unable to locate the winner based on the information provided on the entry form within 24 hours of the random drawing, an alternate winner will be selected from all other eligible entries. All federal, state, and local taxes, license, auto insurance, title fees, and registration fees are the sole responsibility of the winners. To the extent required by law, taxes may be deducted from any prize upon notice to any winner. An IRS form 1099 will be issued by WAFB TV for all prizes valued at $600 or more. All prize winners must show driver’s license or other form of governmental issued-picture ID to claim prize and will be required to sign and return an affidavit of eligibility and release of liability form within 24 hours of notification or attempted notification. Failure to respond within that time frame will result in forfeiture of the prize and an alternate winner will be selected from the remaining eligible entries. Prizes are not transferable and no substitution of prizes or cash redemption of prizes is permissible, except by sponsor who may substitute a prize of equal or greater value if featured prize is unavailable. Winners must take possession of any prizes awarded by February 14, 2010.
ELIGIBILITY/RESTRICTIONS: Employees of WAFB TV, Raycom Media, Inc., Yancey Marketing Corporation, and other participating sponsors, and their affiliates, franchisees, promotions and advertising agencies, and the family and household members of each of them, are not eligible to participate. Sweepstakes is open to legal residents of Louisiana and Mississippi only who are 18 years of age or older at time of entry. Only one prize winner per household. You may win a maximum of one prize. Void where prohibited by law. Sweepstakes is subject to federal, state, and local laws and regulations. All aspects of the Sweepstakes, including scheduling and the awarding of prizes, are subject to Acts of God, force majeure, and any other acts or conditions beyond the express control of the Sponsors of this Sweepstakes. Acceptance of any prize awarded constitutes permission to use the winner's name and likeness for promotion, advertising and publicity purposes at no additional compensation, except where prohibited, by Sponsors and Sponsors’ designees. The winners, by entering the Sweepstakes and accepting the prize, agree to release all sponsors, and their parent, affiliated and subsidiary companies, and their officers, directors, employees, agents, shareholders, affiliates, licensees, franchisees, suppliers, distributors, and advertising agencies from all liability, claims, or actions whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the contest, the receipt, ownership, use or misuse of the prize, and while preparing for, participating in and/or traveling to or from any prize related activity.
LIMITATIONS OF LIABILITY: By entering the Sweepstakes, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and WAFB TV and Yancey Marketing, shall be governed by, and construed in accordance with the laws of the State of Louisiana, without giving effect to any choice of law or conflict of law rules or provisions (whether of Louisiana, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Louisiana. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. WAFB’s and Yancey Marketing’s decisions regarding the selection of winners and all other aspects of the Sweepstakes shall be final and binding in all respects. WAFB TV, Yancey Marketing and the other sponsors will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Sweepstakes.
GENERAL RELEASE: By entering the Sweepstakes, entrants release WAFB TV, Yancey Marketing Corp., Raycom Media, Inc. , and any other promotional companies or sponsors involved in this promotion, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents, from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Sweepstakes or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light). In order to preserve the original intent or to ensure the fairness of this promotion, WAFB TV may modify these rules by providing notice on its website.
