OFFICIAL RULES
HOW TO ENTER: No purchase necessary to enter or win. Louisiana residents must be 18 or older to enter. Mississippi residents must be 21 or older to enter. Complete and submit the registration at WAFB.com. Limit: one (1) Sweepstakes entry per person, per email address during the Promotion Period beginning at 8:00am September 6, 2010. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that participant's entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the registrant or player. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder. You can also enter by hand printing your name, address, and daytime phone number on a 3” x 5” card or piece of paper and mailing it to WAFB and E Federal Credit Union Big Play Sweepstakes , 31 S. Rangeline Rd., Carmel, IN 46032 . All entries must be postmarked and received by 5:00pm, November 28, 2010. No photocopies, facsimiles or mechanically reproduced entries will be accepted. No more than one entry may be submitted per stamped outer envelope. Maximum one (1) entry per person and ten (10) unique entries per household. WAFB-TV will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries. Any questions regarding the number of entries submitted shall be determined by WAFB-TV in its sole discretion, and WAFB-TV reserves the right to disqualify any entries by persons that WAFB-TV determines have tampered with or abused any aspect of the Sweepstakes.
HOW TO PLAY:Following selected college football games televised on WAFB-TV (SEC college football on CBS) beginning Monday September 13, 2010 through Sunday November 28, 2010 for a total of 12 total games included in the contest. There will be a prize drawing from all the entries received to date after each selected game (12 total drawings) with a drawing for each day’s corresponding play of the game. The first name drawn for each game will win the prize associated with that week’s selected Big Play Sweepstakes Prize-Play that occurs (if any) during that week’s game. A name will be drawn and prize awarded only if the following conditions are met for the specific game and week:
Game dates are 9/18, 9/25, 10/2, 10/9, 10/16, 10/23, 10/30, 11/6, 11/13, 11/20, 11/ 26, and 11/27 all in 2010. Each game will have one selected Prize-Play available. Each prize listed below will be offered during two selected games of the 12-game campaign. If the game that WAFB-TV broadcasts produces any of the following Big Plays during the selected game the corresponding prize listed will be awarded. Plays nullified by a penalty are not considered eligible plays. Games will be determined each week by WAFB and listed at WAFB.com contest site, and promoted on WAFB-TV.
PRIZES AWARDED: Identification of official plays will be determined by WAFB-TV and Yancey Marketing Corporation, Determination of the judges are final. The winners of major prizes will be contacted by letter or phone from an authorized representative of WAFB-TV. No other notification will be given. If WAFB-TV is unable to locate the winner based on the information provided on the entry form within 72 hours of the drawing, an alternate winner will be selected from all other eligible entries. All federal, state, and local taxes, license, auto insurance, and registration fees are the sole responsibility of the winner. An IRS form 1099 will be issued by WAFB-TV for all prizes valued at $600 or more. All major prize winners must show driver’s license or other form of picture ID to claim prize and will be required to sign and return an affidavit of eligibility and release of liability form within seven (7) days of notification or attempted notification. Failure to respond within that time frame will result in forfeiture of the prize and an alternate winner will be selected from the remaining eligible entries. The prizes are not transferable and no substitution of prizes or cash redemption of prizes is permissible, except by sponsor who may substitute a prize of equal or greater value if featured prize is unavailable. Winner agrees to the use of his or her name and likeness to be used in association with receipt of prize, or prize will be forfeited and awarded to alternate winner. Allow fourteen (14) days for delivery. Winners must take possession of any major prizes awarded by December 15, 2010.
ELIGIBILITY/RESTRICTIONS: Employees (and their immediate family and household members) of WAFB-TV , Raycom Media, Yancey Marketing Corporation, SCA promotions, E Federal Credit Union, Anytime Fitness, Southern BBQ, Go Auto, Diamond Mazda, Little Caesars, Stomas Furniture, and other participating sponsors, their affiliates, franchisees, promotions and advertising agencies, are not eligible to participate. Game contest is open to legal residents of Louisiana, and Mississippi. This promotion is open only to legal U.S. residents of Louisiana, who are 18 years of age or older at the time of entry and residents of Mississippi who are 21 years of age or older at the time of entry. There may be one prize winner per household. You may win only once. Void where prohibited by law. Game contest is subject to federal, state, and local laws and regulations. All aspects of the game, including scheduling and the awarding of prizes, are subject to acts of God, force majeure, and any other acts or conditions beyond the express control of the sponsors of this contest. Acceptance of any prizes awarded constitutes permission to use the winner's name and likeness for promotion, advertising and publicity purposes at no additional compensation, except where prohibited. The winners, by entering the sweepstakes and accepting the prize, agree to release all sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, licensees, franchisees, suppliers, distributors, and advertising agencies from all liability, claims, or actions whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the contest, the receipt, ownership, use or misuse of the prize, and while preparing for, participating in and/or traveling to or from any prize related activity.
LIMITATIONS OF LIABILITY: By entering the Sweepstakes, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and WAFB-TV 9 and Yancey Marketing, shall be governed by, and construed in accordance with the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules or provisions (whether of Louisiana, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Louisiana. The invalidity or un-enforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. WAFB-TV’s and Yancey Marketing’s decisions regarding the selection of winners and all other aspects of the Sweepstakes shall be final and binding in all respects. WAFB-TV and Yancey Marketing will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Sweepstakes.
GENERAL RELEASE: By entering the Sweepstakes, contestants release WAFB-TV, Yancey Marketing Corp., and any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Sweepstakes or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
Each winner agrees to the use of his or her name and likeness in publicity without any additional compensation, except where prohibited by law. By entering this promotion, each winner acknowledges that WAFB-TV, and all other sponsors and venues, have the right to publicize and broadcast each winner’s name, voice, and likeness, the fact that he or she won, and all matters incidental thereto.
